These Terms of Service (“Terms”) govern your access to and use of ExpressAi (operating expressai.bot, hereafter “we”, “us”, “our”), including our website, dashboard, and the WhatsApp Business AI agents we operate on your behalf. By creating an account or using the service, you agree to these Terms.
1. Who We Are
The service is provided by ExpressAi, operating the website expressai.bot and providing AI agents over WhatsApp Business for local businesses and tourism in Benicàssim, Spain.

2. The Service
ExpressAi lets businesses configure and operate AI assistants that answer customers over WhatsApp. The service includes:
- A dashboard to create agents, set their personality, manage a knowledge base, and review conversations.
- Connection of a WhatsApp Business number through Meta's official onboarding, including Coexistence where your existing number is shared between the WhatsApp Business app and the Cloud API.
- Optional integrations (such as Google Calendar and Gmail) that you choose to enable.
We may add, change, or remove features over time. We will give reasonable notice of material changes that adversely affect you.
3. Accounts & Eligibility
To use the dashboard you must create an account and be at least 18 years old (or the age of majority where you live) and authorised to act for the business you represent. You agree to:
- Provide accurate account and business information.
- Keep your login credentials confidential and not share your account.
- Be responsible for all activity that occurs under your account.
Notify us promptly at contact@martaoryl.com if you suspect unauthorised use of your account.
4. WhatsApp, Meta & Third-Party Terms
The service relies on the WhatsApp Business Platform provided by Meta Platforms Ireland Ltd. By connecting a number you also agree to comply with:
- The WhatsApp Business Messaging Policy and Commerce Policy.
- Meta's applicable platform and developer terms.
- The terms of any third-party integration you enable (for example Google services).
You authorise us, as your technology provider, to access and manage your WhatsApp Business Account and connected number on your behalf solely to provide the service. You may revoke this access at any time by disconnecting the number or closing your account.
5. Acceptable Use
You agree not to use the service to:
- Send spam, unsolicited bulk messages, or message users without a lawful basis or required opt-in.
- Distribute unlawful, fraudulent, deceptive, harassing, or infringing content.
- Violate the privacy or rights of message recipients, or process their data without a valid legal basis.
- Reverse engineer, disrupt, overload, or attempt unauthorised access to the service or its infrastructure.
- Misrepresent your identity or impersonate another business.
You are responsible for the content your agents send and for obtaining any consent required from your customers. We may suspend or limit the service to protect users, comply with Meta's policies, or stop abuse.
6. Your Content & Data
You retain ownership of the content you provide — agent settings, knowledge base, prompts, and the messages exchanged with your customers. You grant us a limited licence to host and process this content as needed to operate the service.
Our handling of personal data is described in our Privacy Policy. You are the controller of your customers' personal data and are responsible for having a lawful basis to process it; we act as your processor for that data.
7. Fees & Payment
Some plans or features are paid. Where fees apply, you agree to pay the prices and billing terms presented at sign-up or in your order. Note that messages sent over the WhatsApp Cloud API may incur Meta's own conversation-based charges, which are separate from our fees.
Unless stated otherwise or required by law, fees are non-refundable. We may change pricing with reasonable advance notice for future billing periods.
8. Service Availability
We aim to keep the service available and reliable, but we do not guarantee uninterrupted or error-free operation. The service may be temporarily unavailable for maintenance, updates, or due to factors outside our control, including outages of Meta, WhatsApp, AI providers, or hosting infrastructure.
9. Intellectual Property
The service, including its software, design, and branding, is owned by ExpressAi and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to copy, modify, or redistribute the service except as expressly permitted.
10. Disclaimers
The service is provided “as is” and “as available”. AI-generated responses may be inaccurate or incomplete; you are responsible for reviewing and, where appropriate, supervising the agent's output. To the extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Limitation of Liability
To the maximum extent permitted by law, ExpressAi will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Nothing in these Terms limits liability that cannot be excluded under applicable law, including mandatory consumer-protection rights.
12. Suspension & Termination
You may stop using the service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, create risk or legal exposure, or violate Meta's policies.
On termination, your right to use the service ends. We will delete or return your data in line with our Privacy Policy and applicable retention requirements.
13. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above will reflect any change, and we will announce material changes on the website or by email when appropriate. Continued use of the service after changes take effect means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. Disputes will be subject to the competent courts of Spain, without prejudice to any mandatory consumer rights you may have in your country of residence.
